CONSTITUTIONAL DAMAGES: JUSTICE FOR THE POOR?

The Supreme Court of Appeal has taken a firm stand against the rampant breach by provincial governments of their constitutional obligation to provide social assistance by granting constitutional damages to Mrs Kate after it took the Eastern Cape Social Development Department more that three years to decide whether she was entitled to a disability grant.
