• Assisted in advising the Department of Trade, Industry and Competition in respect of the merger whereby Impala Platinum Holdings Ltd increased their ownership stake in Royal Bafokeng Platinum Holdings Ltd beyond the requisite 50% +1 mark – thereby acquiring control of the company.*
• Assisted in advising the Department of Trade, Industry and Competition in respect of the proposed transaction whereby Northam Platinum Holdings Ltd attempted to acquire Royal Bafokeng Platinum Holdings Ltd, as a competing transaction to the deal with Impala Platinum Holdings Ltd.*
• Assisted in advising the Department of Trade, Industry and Competition regarding Remgro Ltd’s and MSC ZAR 87 billion acquisition and subsequent privatisation and delisting of the Mediclinic group of companies.*
• Assisted is representing FirstRand Bank Ltd as an interested party in respect of Accelerate Property Fund’s ZAR 580 million sale of their share in the Portside Tower, Cape Town’s largest building, to Cavaleros Group Holdings.*
• Assisted in the filing and securing of the necessary competition authority approval regarding the acquisition of the site for what is to be the largest private tertiary education facility in the country by the Independent Institute of Education, from one of the largest banks in Southern Africa.*
• Assisted in the preparation of the requisite merger filing on behalf of the largest lithium-ion battery producer in Africa, the subsequent negotiations with the competition authorities in relation thereto, and the structuring of a new deal thereafter.*
• Assisted in obtaining merger approval in respect of a prominent private equity fund’s acquisition of one of the largest buildings in the Johannesburg CBD, from FirstRand Bank Ltd.*
• Assisted in advising one of the world’s largest online intermediary platforms in respect of the potential restructuring of their South African operations in light of impending legislative changes to the country’s transport framework – particularly with regard to the competition law consequences thereof and recommended deal structure.*
• Assisted in advising a prominent South African medical aid provider pursuant to an investigation being carried out by the Competition Commission regarding access to and the provision of certain classes of medication in the medical sector.*
• Assisted in advising Golden Fried Chicken Pty Ltd t/a Chicken Licken in respect of the Competition Commission’s Online Intermediary Platforms Market Inquiry, including the relevant negotiations and subsequent compliance with the recommended remedial action thereafter.*
• Assisted in advising the South African Medical Association regarding various written submissions and advisories to the Competition Commission concerning multiple proposed block exemptions in the medical services industry.*
• Assisted in advising one of Africa’s most pre-eminent airlines pertaining to a multi-jurisdictional exemption application for condonation in respect of potential transgressions of the local competition and regulatory frameworks.*
• Assisted in advising the largest freight rail company in Southern Africa regarding the competition law compliance of their internal logistics frameworks, including the drafting of various policy documents and internal guidance notes in this regard.*
• Assisted in advising Access Bank (South Africa) Ltd regarding alleged complaints of cartel conduct and collusive behaviour, including in respect of the concomitant investigations, requests for information and impending complaint referral in relation thereto.*
• Assisted in representing one of Africa’s largest broadcasting consortiums with regard to a Common Market for Eastern and Southern Africa investigation lodged against them and a host of other prominent broadcasting bodies throughout the African continent.*
• Assisted in representing one of the largest Banks in Africa in the widely publicised litigation against the Sekunjalo Group of Companies in various streams of litigation, in the Competition Tribunal, Competition Appeal Court and Constitutional Court.*
• Assisted in the lodging of and litigating on a complaint of anti-competitive behaviour in the publishing industry in Eswatini – including in respect of the concurrent litigation to compel the relevant authorities to act in accordance with the directives being handed down in this regard.*
• Assisted in representing a global oil and gas supplier in a multitude of disputes pertaining to inter alia, various petroleum supply agreements, including unlawful competition claims in relation thereto – in private arbitrations in terms of the Petroleum Products Act, the High Court and the Supreme Court of Appeal.*
