Overview

Lexi works with the specialist Corporate Risk litigation team – which forms part of the broader litigation practice group in our Sandton office – focusing on (i) advice relating to Anti-Bribery and Corruption (‘ABC’), including advice as a specialist team to our Corporate colleagues in the context of due-diligences; (ii) the conduct of disputes arising from fraud, corruption and ‘white collar’ misconduct, and other forms of corporate or claims-related risk (this could include cyber related incidents, whistle-blowing complaints and incidents, and implications and contraventions of foreign ABC legislation such as the FCPA or UK Bribery Act); (iii) strategic advice, appearances before Presidentially appointed Commissions and the conduct of disputes arising from investigations and (iv) working collaboratively with colleagues within our Major Incidents service line.

Experience

Lexi has advised:

  • Four South African companies in the High Court in complex proceedings arising from the acquisition and operation of a game ranch, pursuing multi‑party claims against former directors and related service providers for breach of fiduciary duty, secret commissions/secret profits, professional negligence, and regulatory non‑compliance.
  • The South African subsidiary of a Finnish manufacturer in High Court proceedings against a metropolitan municipality following multiple substation fires that cut power to the client’s plant and subsequently resulted in financial losses to client.
  • Two mining companies in the High Court in a complex, multi‑defendant claim against commodities traders and logistics providers arising from the theft and unauthorised export of valuable minerals.
