Overview
Akisha has experience in High Court commercial litigation (both trial and motion proceedings), settlement negotiations, mediation, class actions, medical negligence and malpractice claims and disputes involving pension funds.
She advises on litigation and dispute resolution in commercial and civil claims, pensions and related aspects of investment management and financial services regulation, healthcare and medical malpractice, and regulatory issues as well as disputes arising from fraud and ‘white collar’ misconduct. She has acted for local and international clients in a range of different sectors and industries helping them navigate complex disputes as well as issues arising from or in connection with all aspects of the applicable laws and related risk.
Experience
Akisha has represented and advised:
- The largest institutional investor on the Johannesburg Stock Exchange (JSE) in local and Dutch litigation and mediation proceedings related to accounting irregularities at dual-listed company in which our client is the largest shareholder. The proceedings included the enforcement of various securities;
- The largest institutional investor on the JSE and Africa’s largest pension fund in two separate action proceedings in the Western Cape High Court for the recovery of a billion Rand claim related to unpaid finance loans;
- A large multinational chemical manufacturer in opposing class action certification proceedings;
- The world’s leading medical indemnity insurer and its clients to protect and support healthcare professionals (doctors, dentists, etc.) by offering medicolegal advice, legal assistance for claims, complaints, inquiries, and risk management;
- A sectoral pension fund in a multimillion-Rand claim brought in the Johannesburg High Court against a leading South African investment consulting firm, focused on the recovery of the Fund’s investment.
- A dispute in the Johannesburg High Court acting for a large South African football club against its former head coach and his agent regarding a breach of contract and the repayment of commissions paid to both parties.
