• Advising various state-owned entities in relation to challenges to public procurement processes, including bringing and defending judicial review proceedings.
• Advising various state-owned entities on the application of the Public Finance Management Act and related legislation and regulations (including preferential procurement) to their operations.
• Advising on the application of municipal legislation.
• Advising international and local clients on various government tender processes including the drafting of procurement documents, procurement evaluation, as well as advising on challenges to public procurement processes. This includes conducting bid evaluations and the drafting of evaluation reports on large-scale projects.
• Advising the state party, National Treasury, lenders, sponsors and/or concessionaires on the regulatory and procurement aspects of public private partnerships.
• Advising the Minerals Council of South Africa in a constitutional challenge brought by the South Africa Local Government Association to the manner in which electricity is reticulated, which matter has significant implications for sustainable mining operations and the transition to a carbon neutral economy.
• Advising on dispute resolution proceedings in the construction and infrastructure sectors, particularly litigations and arbitrations.
• Member of the Eskom State Capture Task Team advising on governance, procurement, consequence management and the formulation of implementation plans to recover losses arising from State Capture. Aliyah was part of the team who investigated past corruption at Eskom and continues assisting Eskom with litigation proceedings and the Zondo Commission into State Capture, including engagements with suppliers in relation to disciplinary processes and investigations into misconduct.
• Conducting due diligence exercises in respect of environmental and other regulatory compliance issues in a range of sectors.
• Extensive experience in the gambling, gaming and lotteries sectors and has advised a number of local and international clients in their operations in these sectors.
• Advised a consortium in its bid for the National Lottery and Sports Pool Licence, including: in the preparation of its bid and all necessary contracting arrangements, compliance with lotteries and gaming laws and the requirements of the request for proposal, as well as general ongoing advice in this regard.
• Advising a global operator of a floating power plant fleet on regulatory compliance aspects in relation to a South African powership project.
